OF PA SCHOOL Employer and AFT PENNSYLVANIA Petitioner Case 04-RC-148637 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered objections in a secret-ballot election held April 30, 2015, and the hearing officer's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 104 ballots cast for the Petitioner and 38 ballots cast against the Petitioner, with 16 challenged ballots, an insufficient number to affect the results. On September 25, 2015, the Board granted the Employer’s request to withdraw its July 22, 2015 exceptions to the hearing officer’s report. Accordingly, the Board adopts the hearing officer's findings and recommendations, and finds that a certification of representative should be issued.1 1 The hearing officer recommended overruling the Employer’s objections. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for AFT Pennsylvania and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: VOTING GROUP - UNIT A (PROFESSIONAL UNIT): Included: All full-time and regular part-time professional employees, including teachers, co-teachers, psychologists, counselors, deans, instructional assistants/aides, special education paraprofessionals, in-house substitute teachers, nurses, and librarians employed by the Employer at its 100 W. Duncannon Street, Philadelphia, PA educational facility. Excluded: All other employees, including non-professional employees, office clerical employees, managerial employees, confidential employees, maintenance employees, guards, and supervisors as defined in the Act. VOTING GROUP - UNIT B (NON-PROFESSIONAL UNIT): Included: All full-time and regular part-time non-professional employees, including truancy liaisons, mentor coordinators, transition assistants, and administrative assistants employed by the Employer at its 100 W. Duncannon Street, Philadelphia, PA educational facility. Excluded: All other employees, including professional employees, office clerical employees, managerial employees, confidential employees, maintenance employees, guards, and supervisors as defined in the Act.
