I. 0.) Case No. R-1970 SECOND SUPPLEMENTAL DECISION AND- ORDER November 29, 1940 On August 31, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Election, an election by secret ballot was conducted on September 20, 1940, under the direction and supervision of the Regional Director for the First Region (Boston, Massachusetts). On November 6, 1940, the Board issued a Supplemental Decision and Direction,2 which, among. other things, directed the Regional Director to open and count a challenged ballot. Pursuant to the Supplemental Decision and Di- rection, the Regional Director, acting pursuant to Article III, Sec- tion 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, issued and duly served upon the parties a Second Supplemental Report, setting forth that on November 14 the Regional Director opened the ballot, and that upon a count of said ballot'the results of the election were as follows: Total number of voters eligible______________________________ 63 Total valid votes cast_______________________________________ 63 Total number of ballots-marked "Yes"_______________________ 31 Total number of ballots marked "No"________________________ 32 Total number of blank ballots_______________________________ 0 Total number of void ballots _________%_____________________ 0 No objections to the counting of the ballot or to the Second Sup- plemental Report have been filed by any of the parties. The results- of the election show that no collective bargaining representative has been selected by a majority of the employees in the unit heretofore found to be appropriate for the purposes of 2 27 N. The petition for investigation and certifica- tion of representatives of employees of Moulton Ladder Manufac- turing Company, Somerville, Massachusetts, will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and cer- tification of representatives of employees of Moulton Ladder Manu- facturing Company, Somerville, Massachusetts, filed by United Furniture Workers of America, Local 136-B (C.
