R-818 and R-820, respectively SUPPLEMENTAL DECISION AND ORDER November 7, 1938 On July 28, 1938, the National Labor Relations Board, herein, called the Board, issued a Decision and Direction of Election in the above-entitled case.' The Direction of Election directed that an election by secret ballot be conducted v itliin fifteen (15) days from the date of the Direction among all the production, maintenance, and shipping employees, whose names appear on the pay roll of Metro- politan Engineering Co. and Metropolitan Device Corp. for the week ending January 1, 1938, excluding salesmen, guards, watchmen, research workers, clerical, office, and supervisory employees, and those who had since quit or been discharged for cause, to determine whether they desired to be represented by International Brother- hood of Electrical Workers, Local Union No. 3, or Local No. 1224 of United Electrical, Radio and Machine Workers of America, for the purposes of collective bargaining, or by neither. Pursuant to the Direction, an election by secret ballot was con- ducted on August 12, 1938, at Brooklyn, New York, under the direc- tion and supervision of the Regional Director for the Second Region (New York City): On August 15, 1938, the said Regional Director, acting pursuant to Article III, Section 9, of National Labor Rela- tions Board Rules and Regulations-Serial 1, as amended, issued and served upon the parties an Intermediate Report on the ballot. 18 N. B, No. 63. 674 DEC I S1 oN 5 .v N LI ORDERS 675 As to the results of the secret ballot, the Regional Director reported as follows : Total number eligible to vote_______________________________ 200 Total number of ballots cast________________________________ 182 Total number of ballots counted_____________________________ 175 Total number of votes in favor of Local No 1224 of United Electrical, Radio and Machine Workers of America_________ 34 Total number of votes in favor of International Brotherhood of Electrical Workers, Local Union No. 3___________________ 27 Total number of votes in favor of neither union______________ 114 Total number of blank ballots_______________________________ 0 Total number of void ballots________________________________ 0 Total number of challenged ballots__________________________ 7 't'hereafter Local No. 1224 of United Electrical, Radio and Ma- chine Workers of America and International Brotherhood of Elec- trical Workers, Local Union No. 3, filed objections to the Interme- diate Report. The Regional Director found these objections to be without merit, and we also so find. The results of the election show that no collective bargaining rep- resentative has been selected by a majority of the employees. The petitions for investigation and certification of representatives of em- ployees of Metropolitan Engineering Co. and Metropolitan Device Corp., Brooklyn, New York, will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY ORDERED that the petitions for investigation and cer- tification of representatives of employees of Metropolitan Engineer-' ing,Co. and Metropolitan Device Corp., Brooklyn, New York, filed by International Brotherhood of Electrical Workers, Local Union No. 3, and Local No. 1224 of United Electrical, Radio and Machine Workers of America be, and they hereby are, dismissed.
