Case No. B-2093 SUPPLEMENTAL DECISION AND ORDER December IA, 1940 - On October 31, 1940 the National Labor Relations Board, herein called the Board, issued a ,Decision and Direction of Election' in the above-entitled case. Pursuant to the Direction of Election, an election by secret ballot was conducted on November 26, 1940, at Waterloo, Iowa, under the direction and supervision of the Regional Director for the Eighteenth Region (Minneapolis, Minnesota)., On November 29, 1940 the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regu- lations-Series 2, as amended, issued and duly served upon the parties his Election Report. As to the balloting and its results, the Regional Director reported as, follows: Total number eligible________________________________________ 26 Total number of ballots citst -------------------------------- 26 Total number of votes cast_________________________________ 26 Total number of ballots cast for United Packinghouse Work- ers of America , Packinghouse Workers Organizing Com- mittee, Local Union No. 46 (C. I. 0.) --------------------- 13 Total number^of ballots cast against above organization ------- 13 Total number of blank ballots_______________________________ 0 Total number of void ballots_________________________________ 0 Total number of challenged ballots__________________________ 0 On December 4, 1940, objections to the conduct of the, election were filed on behalf of the Union; and on December 7, 1940; the Company filed its Answer to Objections to Conduct of Election. Thereafter, by letter dated December 9, 1940, the objections previously filed on behalf of the Union were withdrawn. 127 N. L. R B 1188. 28 N. L. The Union's petition for investigation and cer- tification of representatives of employees of the Company will there- fore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and cer- tification of representatives of employees of Mather Humane Stock Transportation Company, Waterloo, Iowa, filed by United Packing- house Workers of America of the P.
