Marshall Field Sheeting MillDownload PDFNational Labor Relations Board - Board DecisionsMar 22, 19386 N.L.R.B. 108 (N.L.R.B. 1938) Copy Citation In the Matter Of MARSHALL FIELD SHEETING MILL and TEXTILE WORKERS ORGANIZING COMMITTEE Case No. R-534 CERTIFICATION OF REPRESENTATIVES March 22, 1938 On February 18, 1938, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled case.' The Direction of Election directed that an election by secret ballot be conducted among all employees of Marshall Field & Company who were on the pay roll of the Company at its Marshall Field & Company Sheeting Mill,2 Draper, North Carolina, during the pay-roll period next preceding the filing of the petition; ex- clusive of clerical, sales, and supervisory employees and except those who have quit or have been discharged for cause between that period and the date of the election, to determine whether or not they desire to be represented by Textile 'Workers Organizing Committee, for the purposes of collective bargaining. Pursuant to the Direction, an election by secret ballot was con- ducted on March 2, 1938, under the direction and supervision of the Regional Director for the Fifth Region (Baltimore, Maryland). Thereafter, on March 7, 1938, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued and duly served upon the parties an Intermediate Report on the election. No objections or exceptions to the Intermediate Report have been filed by any of the parties. B. 393. 2 Erroneously designated as Marshall Field Sheeting Mill in the Order of Consolidation and Directing Investigation and Hearing. 108 DECISIONS AND ORDERS 109 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Section 8, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED that Textile Workers Organizing Commit- tee has been designated and selected by a majority of all employees of Marshall Field & Company at its Marshall Field & Company Sheet- ing Mill, Draper, North Carolina, excluding clerical, sales, and super- visory employees, as their representative for the purposes of collective bargaining and that, pursuant to the, provisions of Section 9 (a) of the National Labor Relations Act, Textile Workers Organizing Com- mittee is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay , wages, hours of employment, and other conditions of employment.
