EMANUEL, MEMBER Dated, Washington, D.C., April 1, 2020. 1 In denying review, we find that the Acting Regional Director’s decision to proceed with the hearing on December 6, 2019 was permissible under the representation-case procedures currently in effect. We observe, however, that the Acting Regional Director’s decision in this regard raises many of the concerns that led the Board to recently adopt procedural changes that will allow additional time for the parties to prepare for the pre-election hearing and for the regional director to postpone the opening of the hearing for good cause. See 84 Fed. Reg. 69524, 69525, 69533- 69534 (Dec. 18, 2019). Those amendments are not effective until May 31, 2020, however. 85 Fed. Reg. 17500 (Mar. 30, 2020).
