Pursuant to the Direction of Election, an election by secret ballot was conducted on February 13, 1940, under the direction and supervision of the Regional Director for the Sixth Region (Pittsburgh, Pennsylvania ). On February 27, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended , issued an Election Report, copies of which were duly served upon the parties . No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. As to the balloting and its results , the Regional Director reported as follows : Total number of eligible voters------------------------------ 64 Total number of ballots counted ----------------------------- 64 Total number of votes for Steel Workers Organizing Committee, Local No. 2117, on behalf of Amalgamated Association of Iron, Steel and Tin Workers of North America, affiliated with the Congress of Industrial Organizations 2---------------------- 27 Total number of votes for Defenders of America , Pittsburgh Chapter No 23-------------------------------------------- 37 Total number of votes for neither------ ---------------------- 0 Total number of blank ballots -------------------------------- 0 Total number of void ballots --------------------------------- 0 'Total number of challenged votes4--------------------------- 0 By virtue of and.pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- 119 N. L R B 756 2 During the conduct of the election , 6 votes were challenged by the S. W. 0. C. and 3 by the Defenders . On February 23, 1940, the parties entered into an agreement in which they waived their respective challenges and agreed that the challenged votes were cast by eligible employees and should be counted and tabulated by the Regional Director. 3 See footnote 2, supra. B., No. 66. 669 670 DECISIONS OF NATIONAL LABOR RELATIONS BOARD tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS "HEREBY CERTIFIED that Defenders of America; Pittsburgh Chapter No. 2, has been designated and selected by a majority of the production, maintenance, and service employees of Lawson Manu- facturing Company, Pittsburgh, Pennsylvania, including the night janitor, but excluding clerks, foremen, and supervisory employees, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, Defenders of America, Pittsburgh Chapter No. 2, is the exclusive representative of all such employees for the purposes of collective bargaining 'in respect to rates of pay, wages, hours of employment, and other conditions of employment.
