Case No. R-1873 CERTIFICATION OF REPRESENTATIVES September 4, 1940 On July 9, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election 1 in the above- -entitled case, and on August 7, 1940, issued a Supplemental Decision and Second Direction of Election 2 directing that a run-off election by secret ballot be conducted among certain employees of Klauber Wangenheim Co., to determine whether they desired to be repre- sented by International Longshoremen's and Warehousemen's Union, Local No. 1-38, C. I. 0., or by International Brotherhood of Team- sters, Chauffeurs, Stablemen and Helpers, Local No. 542, A. F. of L., for the purposes of collective bargaining. Pursuant to the Second Direction of Election, an election by secret ballot was conducted on August 17, 1940, under the direction and supervision of, the Regional Director for the Twenty-first Region (Los Angeles, California). On August 19, 1940, the Regional Direc- tor, acting pursuant to Article III, - Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, pre- pared and duly served upon the parties a Run-off Election Report, setting forth the results of the election. No objections to the conduct of the ballot or the Election Report have been filed by any of the -parties. F. of L------------------------------------------------ 24 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49-Stat. 449, and pursuant to Article III, Section 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2; as amended, IT IS HEREBY CERTIFIED that International Longshoremen's and Warehousemen's Union, Local No, 1-38, C. I. 0., has been designated and- selected by a majority of all truck drivers, grocery packing room employees, paper furnishings and notions packing room employees, cigar-candy-beverage packing room employees, manufacturing de- partment employees, shipping and receiving employees and floormen, and janitors at Klauber Wangenheim Co.'s San Diego plant, includ- ing all employees in the five cash-and-carry stores and in the Long Beach branch employed by Klauber Wangenheim Co. but excluding working foremen and other supervisory employees, as their repre- sentative for the purposes of collective bargaining and that, pursuant to Section 9 (a) of the Act, International Longshoremen's and Ware- housemen's Union, Local No. 1-38, C. I. 0., is the exclusive repre- sentative of such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other- conditions of employment.
