Petitioner ORDER The Employer’s Request for Review of the Regional Director’s decision to defer litigation of the supervisory status of 86 individuals in the petitioned-for unit is denied as it raises no substantial issues warranting review.1 The Employer’s Request for Expedited Consideration and Application for a Stay Pending Review are denied as moot. EMANUEL, MEMBER Dated, Washington D.C., January 22, 2020. 1 In denying review, we find that the Regional Director’s decision to defer litigation of the supervisory status of these 86 individuals was permissible under the representation-case procedures currently in effect. We observe, however, that the Regional Director’s decision raises many of the concerns that led the Board to recently adopt procedural changes that will limit regional directors’ discretion to defer litigation and resolution of eligibility disputes. See 84 Fed. Reg. 69524, 69538-69542 (Dec. 18, 2019). Those amendments are not effective until April 16, 2020, however. See id. at 69524.
