On August 16, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report. As to the balloting and its results, the Regional Director reported as follows : Total on eligibility list------------------------------------ 899 Total ballots cast---------------------------------------- 851 Total ballots challenged----------------------------------- 31 a. On August 28, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties a report on the objections contained in the protest filed by the Council in which he recommended that the protest be dismissed as being without merit. . The Board has fully considered the objections filed by the Council and finds that they do not raise substantial or material issues with respect to the conduct of the ballot or the Election Report. The objec- tions are hereby overruled. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended. IT IS HEREBY CERTIFIED that Sugar Workers' Local Union No. 21934, affiliated with the American Federation of Labor, has been designated and selected by a majority of all production and maintenance em- ployees of Godchaux Sugars, Inc., at its Reserve, Louisiana, plant, including sugar boilers, ground and yard employees, narrow-gauge railroad employees, Servall department employees, electric-truck oper- ators, longshoremen, samplers, entrainment men, car knockers, tool- room employees, Willie Dent, J. S. Blunt, Clifford F. Landy, and Ernest Duhe, but excluding supervisory, agricultural and clerical em- ployees, checkers and weighers, lodging-house attendants, community- club employees, chemists and bench chemists, truck drivers and garage- men; welfare-department employees, watchmen, and employees listed in Appendices A and B of the Board's Decision and Direction of Elec- tion, as their representative for the purposes of collective bargaining, and that pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Sugar Workers' Local Union No. 21934, affiliated with the American Federation of Labor, is the-exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other condi- tions of employment.
