R-1721 to R-1731, inclusive SUPPLEMENTAL DECISION CERTIFICATION OF REPRESENTATIVES DIRECTION OF RUN-OFF ELECTIONS AND ORDER May 29, 1940 On February 28, 1940, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Elections in the above-entitled proceedings.' On April 15, 1940, the Board issued an Amendment to Direction of Elections.2 In its Decision and Direction of Elections and the Amendment thereto, the Board, in accordance *ith a stipulation entered into by all the parties to these proceedings, directed that separate elections by secret ballot be conducted : (1) Among the employees of General Motors Corporation, herein called the Company, in the work classifications set forth in the foot- note hereto,3 said employees being. herein called the pattern makers, 120 N. B. 986. 3 Wood pattern makers and model makers , working on bench or machine (but not shaper hands ), metal pattern makers working on bench or machine, model and pattern checkers, keller model set-up men , and the apprentices of these classifications (but not supervisory or salaried employees and those whose work is of a confidential nature). 24 N. B., No. 6. 159 160 DECISIONS OF NATIONAL LABOR RELATIONS BOARD at each of nine plants of the Company to determine whether they desired to be represented by the Pattern Makers League of North America, affiliated with the A. F. of L., herein called the Pattern Makers, or by International Union, United Automobile Workers of America, affiliated with the C., I. 0., herein called the C. I; 0, U. A. W., for,the purposes of collective bargaining, or by neither; (2) Among the pattern makers at one plant of the Company to determine whether or not they desired to be represented by the Pattern Makers for the purposes of collective bargaining; (3) Among the employees of the Company in the work classifica- tions set forth in the footnote hereto,4 said employees being herein called the die sinkers, at one plant of the Company to determine whether they desired to be represented by Lodge 1411, International Association of Machinists, affiliated with the National Die Sinkers Conference (A. F. L.), or by the C. I. O.-U. A. W., for the purposes of collective bargaining, or by neither; (4) Among the die sinkers at one plant to determine whether they desired to be represented by Lodge 1217, International Association of Machinists, affiliated with the National Die Sinkers Conference (A. F. L.), or by the C. I. O.-U. A. W., for the purposes of collective bargaining, or by neither; and (5) Among the employees of the Company in the work classifica- tions set forth in the footnote hereto,,' said employees being herein called the production and maintenance employees, at 58 plants of the Company to determine whether they desired to be represented by In- ternational Union, United Automobile Workers of America, affiliated with the A. F. of L., herein called the A. F. L.-U. A. W., or by the 4 Impression die sinkers employed in the manufacture or maintenance of dies used to complete forgins, the said employees to include die sinkers on bench , mill, lathe, and other machines : trim die makers ; kellermen ; edgermen and edger grinders ; upset die men ; and turning impression men (but not supervisory or salaried employees and those employees whose work is of a confidential nature). 'Production and maintenance employees , and mechanical employees in engineering de- partment shops, excluding the pattern makers and die sinkers afore-mentioned , direct rep- resentatives of the management , such as officers and directors of the Company, sales managers and assistant sales managers , factory managers and assistant factory managers, directors and employees of sales , accounting , Personnel and Industrial Relations Depart- ments , directors of purchases and assistant directors of purchases, superintendents and assistant superintendents , general foremen , foremen and assistant foremen , and all other persons working in a supervisory capacity , including those having the right to hire or discharge and those whose duties include recommendation as to hiring or discharging (but not leaders ), and those employees whose work is of a confidential nature, time =study men, plant protection employees ( but not to include maintenance patrolmen , or fire patrolmen), all clerical employees , chief engineers and shift-operating engineers in- power plants, de- signing ( drawing board ), production estimating and planning, engineers , draftsmen and detailers , physicists , chemists, metallurgists, artists, designer -artists and clay and plaster modelers ( but not those who make patterns ), timekeepers , technical school students , inden- tured apprentices , and those technical or professional employees who are receiving special training , kitchen and cafeteria help. GENERAL MOTORS CORPORATION 161 C. I. O.-U. A. W., for the purposes of collective bargaining, or by neither. The Board provided that if a majority of the pattern makers or of the die sinkers at any one of the specified plants chose the Pattern Makers or the Die Sinkers respectively, such employees at each such plant would constitute a.separate appropriate bargaining unit, and, further, that if a majority of the pattern makers or of the die sinkers at any one of these plants chose the C. I. O.-U. A. W., they would constitute a separate appropriate bargaining unit, except that where a majority of the production and maintenance employees at any such plant, also chose, the C. I. O.-U. A. W.,. then the employees in such craft and the production and maintenance employees together would constitute a single appropriate unit. The Board further provided that the production and maintenance employees at each plant in which a majority thereof chose the A F. L.-U. A. W. should constitute a single unit appropriate for the pur- poses of collective bargaining, and that the-production 'and mainte- nance employees at each plant in which the majority chose the C'. I. O.-U. A. W. should constitute a single unit appropriate for' the purposes of collective bargaining.6 , Pursuant to the Direction of Elections, as amended, elections by secret ballot were conducted on April- 17, 1940, under the direction and supervision of the Regional Director for the Seventh Region, Detroit, Michigan. On April 25, 1.940; the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series ,2, as amended, issued and duly served upon the parties an Elections Report. On May 1, 1940, the Regional Director issued . and duly served upon the parties a' Correction of Elections Report. The Regional Director omitted from his Report the tally, findings, and recommendations as to three elections, the re- sults of which depend upon. the disposition made of challenged ballots.' As to the balloting and its results; the Regional Director reported in part as follows : - 6 As stated above, such unit would include also the members of any craft group at such plant , the majority of whom also chose the C. I. O.-U. A . No objections or exceptions have been filed by any of the parties with regard to the remaining 65 elections covered in the Elections Report. The results of the election at_ the Harrison Radiator Division, Lockport, New York, show that no collective bargaining representa- tive has been selected by a majority of the employees voting. The petitions for investigation and certification of representatives of the employees of General Motors Corporation, in so far as they refer GENERAL MOTORS CORPORATION 179 to the Harrison Radiator Division, Lockport; New York,-will there- fore be dismissed. The results of the elections at the Chevrolet Motor Division; Baltimore, Maryland, and the Fisher Body Division (Plant #40), Detroit, Michigan, show that neither the A. F. .L.=U. A. W. nor the C. I. 0.-U. A. W. received a majority of the valid votes cast. The majority of employees at each of these plants have, however, indicated a desire to bargain collectively with the Company.8 Both the A. F. L.-U. A. W. and the C. I. O.-U. A. W. have filed with the Regional Director requests for run-off • elections at these two plants. We shall direct that such run-off elections be held. In ac- cordance with the policy enunciated by the majority of the Board in Matter of R. K. Le Blond Machine Tool Co., Cincinnati Electrical Tool Co. and Independent Employees Organization,9 the ballots used in such run-off elections shall contain the names of both labor organizations but no place in which to vote again for "neither"; 10 the organization receiving the higher number of votes to be certified; as exclusive bargaining : representative. W. had filed with him objections to the conduct of the ballot in the aforesaid election and to the Elections Report in so far as it pertained to that election. The C. I. O.-U. A. W. has requested oral argument before the Board on its objections. Such objections allege (1) that campaign literature, telegrams, and information sent to the Kansas City office of the C. I. O.-U. A. W. were delivered to and retained by the Kansas City office of International Union, United Automobile Workers of America, affiliated with the A. F. of L., herein called the A. F. L.-U. A. W., and that, if the C. I. 0.- U. A. W. had not been thereby prevented from distributing such material to the employees at the Kansas City plant, such employees would have voted. for the C. I. O.-U. A. W.; (2) that the A., F. L.- U. A. W., in violation of a pre-election agreement with the C. I. 0.- U. A. W., conducted a vigorous campaign for support on the `day of the election by various described activities at, in, and' near the plant, and that the acts complained of improperly influenced employees to vote for the A. F. L.-U. A. W.; and (3) that a large majority of the employees at the Kansas City plant had stated in writing that they had been misinformed by A. F. L.-U. A. W. officials concerning the election, and desired a new election to enable them to vote for the C. I. O.-U. A. W. The Regional Director, having duly investigated the matters con- tained in the objections of the C. I. O.-U. A. W., reported that a package of lapel buttons designed for use in the pre-election cam- paign, three packages of campaign literature, and three telegrams, all addressed to and intended for the C. I. O.-U. A. W., were mis- delivered by the Post Office Department, the Railway Express Agency; and the. Postal Telegraph Company, respectively, to the GENERAL MOTORS CORPORATION , 199 A. F. L.-U. A. W., and that all of these materials were recovered by the C. I. O.-U. A. W. prior to elections. The Regional Director further reported that the A. F. L.-U. A. W. caused one or more auto- mobiles or trucks bearing campaign slogans to be stationed in and moved about streets adjoining the plant in. question during the time the election was being conducted. - Subsequent to the filing of its objections, and in support of its contention that a majority of the employees involved now desire the C. I. O.-U. A. W. to represent them, the C. I. O.-U. A. W. filed with the Regional Director petitions bearing 567 signatures under the following heading : We, the undersigned employees of Chevrolet-Kansas City divi- sion of General Motors Corporation, having been misinformed by the U. A. W.-A. F. L. officials as to their strength in the General Motors Plants in the N. L. R. B. vote April 17, 1940, .and wishing to be with the majority of the General Motors workers in their bargaining unit, now wish to become affiliated with the bargaining unit of the U. A. W.-C. I. O. so that we may have the maximum bargaining power, protection, and chance to obtain a national contract: We shall assume that the petitions bear signatures of employees who were eligible to vote in the election, and shall consider their effect as evidence of a post-election shift in the desires of certain of the employees. As. has been shown, the A. F. L.-U. A. W. received 566 votes out of 1002 validly cast,. a plurality of 147 over the C. I. 0.- U. A. W., while 17 persons voted for neither union, one spoiled his ballot, and 110 eligible employees refrained from voting. Thus, although the petitions purport to reflect a gain of 148 votes by the C. I. O.-U. A. W., since the identity and choice of the employees who voted does not appear, the actual shift from the A. F. L.-U. A. W. may be as few as 20 votes. Inasmuch as the eligible voting group totals 1113 employees, the relatively small shift reflected by the peti- tions is, in our opinion, insufficient to warrant disturbing the results of the election .9 The Board has fully considered the Elections Report, the Objec- tions, and the Report on Objections, and finds that the objections do not raise substantial and material issues with respect to the conduct of the ballot or the Elections Report. A. introduced in evidence cards signed by 40 engineers employed by the company applying for member- ship in M. E . B. A. I. O.-U. A . W. for oral argument, thereon is hereby denied. We shall accordingly certify the A.,F. L.- U. A. SUPPLEDIENTAL FINDINGS OF FACT We find that the production and maintenance employees, and mechanical employees in engineering -department shops, excluding direct representatives of the management, such as officers and direc- tors of the Company, sales managers and assistant sales managers, factory managers and assistant factory managers, directors and em- ployees of sales, accounting , Personnel and Industrial Relations De- partments , directors of purchases and assistant directors of purchases, superintendents and assistant superintendents , general foremen, fore- men, and assistant foremen, and all other persons working in a supervisory capacity, including those having the right to hire or discharge and those whose duties include recommendation as to hir- ing or discharging ( but not leaders ), and those employees whose work is of a confidential nature, time -study men, plant protection employees (but not to include maintenance patrolmen or fire patrol- men), all clerical employees, chief engineers and shift-operating engineers in power plants , designing ( drawing board ), production estimating , and planning engineers , draftsmen and detailers , physi- cists, chemists , metallurgists , artists, designer -artists and clay and plaster modelers (but not those who make patterns ), timekeepers, technical -school students, indentured apprentices , and those technical or professional employees who are receiving special training, kitchen and cafeteria help, employed by the Company at each of the following plants : Chevrolet Motor Division ( Experimental Laboratories), Ham- tramck, Michigan. Chevrolet Motor Division , Kansas City , Missouri. constitute units appropriate for the purposes of collective bargaining,. and that said units will insure to employees of the Company the full benefit of their right to self-organization and to collective bargaining and otherwise effectuate the policies of the Act. ORDER The Board having duly considered these matters, and deeming it necessary in order to effectuate the purposes of the Act, IT IS HEREBY ORDERED that the Regional Director for the Seventh Region, upon notice to the interested parties and in the presence of such representatives,as the parties may designate, open the ballots cast by Carroll Angle, Oswald Braun, and Andrew J. Fisher in the election among the patternmakers at the Saginaw Malleable Division, Saginaw, Michigan, and issue a further supplemental report on such election ; and IT IS HEREBY FURTHER ORDERED that the Regional Director for the Seventh Region provide, upon due notice, for a supplemental hearing for the sole purpose of permitting the parties hereto to introduce evi- dence which will enable the Board to clarify the definition of the unit provisionally established, in accordance with the stipulation of the parties by the Board's Decision and Direction of Elections, among employees of General Motors Corporation generally engaged in die- sinking operations at the Chevrolet Motor Division (Forge) (Spring and Bumper), Detroit, Michigan, and which will enable the Board to determine the identity of all the employees comprising such provi- sional unit. .
