Fitzgerald Cotton MillsDownload PDFNational Labor Relations Board - Board DecisionsMar 15, 19385 N.L.R.B. 973 (N.L.R.B. 1938) Copy Citation In the Matter of FITZGERALD COTTON MILLS and TEXTILE WORKERS ORGANIZING COMMITTEE Case No. R-482 CERTIFICATION OF REPRESENTATIVES March 15, 1938 By Decision dated January 21, 1938,E the National Labor Relations Board, as part of the investigation authorized to ascertain representa- tives for the purposes of collective bargaining with Fitzgerald Cotton Mills, directed the Regional Director for the Tenth Region, acting as agent for the National Labor Relations Board, and subject to National Labor Relations Board Rules and Regulations-S--ries 1, as amended, to conduct an election by secret ballot among the production and maintenance employees of the Fitzgerald Cotton Mills employed by the Company on July 24, 1937, excluding clerical and supervisory employees, and those employees who have since quit or been discharged' for cause, to determine whether or not they desire to be represented by Textile Workers Organizing Committee for the purposes of collec- tive bargaining. Pursuant to said Direction of Election, the Regional Director con- ducted an election by secret ballot on February 5, 1938. Full oppor- tunity was accorded to all of the parties to this investigation to par- ticipate in the conduct of the secret ballot and to make challenges. Thereafter, on February 11, 1938, the Regional Director, acting pur- suant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued and duly served' upon the parties to the proceeding his Intermediate Report on the ballot. No exceptions to the Intermediate Report have been filed by, any of the parties. B. 1121. 973 `974 NATIONAL LABOR RELATIONS BOARD By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act and pursuant to Article III, Section 8, of National Labor -Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED that Textile Workers Organizing Commit- tee has been designated and selected by a majority of the production and maintenance employees of Fitzgerald Cotton Mills, excluding ,clerical and supervisory employees, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Textile Workers Orgaiiizing Committee, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, -hours of employment, and other conditions of employment.
