The Direction of Election provided that an elec- tion by secret ballot be held within fifteen (15) days from the date of the Direction among the production and maintenance employees, employed by Cudahy Brothers Company 2 at its Cudahy, Wisconsin, plant on October 16, 1937, excluding clerical workers, office workers, supervisory employees, and part-time and temporary employees, and excluding also those employees who had quit or had been discharged for cause prior to the election, to determine whether they desired to be represented by United Packinghouse Workers Local 491,$ or by Amalgamated Meat Cutters and Butcher Workmen of North America, Local 222, for the purposes of collective bargaining, or by neither. Pursuant to the Direction, an election by secret ballot was con- ducted on February 10, 1938. Full opportunity was accorded to all of the parties to this investigation to participate in the conduct of the secret ballot and to make challenges. On February 11, 1938, Nathaniel S. Clark, Regional Director for the Twelfth Region (Mil- waukee, Wisconsin), acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued his Intermediate Report Upon Secret Ballot, copies of which were duly served upon all parties to the proceeding. No exceptions to the Intermediate Report have been filed by any of the parties. 14 N. L It . F. of L.__--_- 243 Ballots cast for neither union ------------------------------- 153 Ballots protested ------------------------------------------ 3 Blank ballots---------------------------------------------- 3 Void ballots----------------------------------------------- 3 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act and pursuant to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED that United Packinghouse Workers, Local No. 491, has been designated and selected by the majority of the production and maintenance employees of Cudahy Brothers Com- pany, at its Cudahy, Wisconsin, plant, excluding clerical workers, office workers, supervisory employees, and part-time and temporary employees, as their representative for the purposes of collective bar- gaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, United Packinghouse Workers, Local No. 491, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of, employment, and other conditions of employment.
