Jun. 30, 2020) Copy Citation UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD COUNTY OF LOGAN AND THE LOGAN COUNTY SHERIFF’S OFFICE Employer and Case 25-WH-255081 ILLINOIS FRATERNAL ORDER OF POLICE LABOR COUNCIL Petitioner CERTIFICATION OF REPRESENTATIVE AS BONA FIDE UNDER SECTION 7(b) OF THE FAIR LABOR STANDARDS ACT OF 1938 On January 22, 2020, Illinois Fraternal Order of Police Labor Council (the Petitioner) filed with the Regional Director for Region 25 of the National Labor Relations Board a request for certification of representative as bona fide under Section 7(b) of the Fair Labor Standards Act of 1938 (FLSA), 29 U.S.C. § 207(b). On February 26, 2020, the Regional Director for Region 25 served on the parties a Notice to Show Cause why the Board should not grant the request. The Employer advised the Region that it had no objection to granting the Petitioner’s request, and no other response was filed. As the Region’s investigation revealed that the Petitioner is the recognized exclusive collective-bargaining representative of the unit employees,1 1 The record indicates that the Employer is a public sector employer, and it contains a copy of the parties’ most recent collective-bargaining agreement, effective by its terms from May 1, 2017 through April 30, 2020; a copy of the Memorandum of Understanding entered into by the parties on May 9, 2019, which states, inter alia, that the collective- bargaining agreement shall be automatically renewed from year to year unless either party gives notice to the other at least 60 days prior to the anniversary date; and a copy of the Illinois Labor Relations Board’s Amendment to Certification issued on April 25, 2019, as well as earlier Certifications of Representative issued on September 22, 2004 2 the Regional Director recommended to the Board that the requested certification be issued. No party having shown cause why the requested certification should not be issued, the National Labor Relations Board certifies that Illinois Fraternal Order of Police Labor Council is a bona fide representative, for purposes of Section 7(b) of the FLSA, of the employees of Logan County and the Logan County Sheriff’s Office in the following unit:2 Included: All full-time employees of the County of Logan and Sheriff of Logan County in the following titles: Dispatcher; Assistant Supervisor. Excluded: All other employees of the County of Logan and Sheriff of Logan County, and all managerial, supervisory, professional and confidential employees as defined by the Illinois Public Labor Relations Act.
