Case No. ' R-1798 SUPPLEMENTAL DECISION AND ORDER June 18, 19!0 On May 13, 1940, the National Labor Relations Board, herein called the Botifd, issiied a Decision and Direction of Election 1 in, the. above- entitled proceeding.. The Direction of Election provided ' that an election by, secret ballot be conducted within thirty (30) days from the date of the Direction among all production employees who were employed by the Century Engraving & Embossing Company during the pay-roll period next preceding the date of the Direction of Elec- tion, including working foremen, errand boys, shipping employees, and employees who did not work dining such pay-roll period because they were ill or on vacation,' and employees' who' were then or have since been temporarily laid off, but excluding -clerical em- ployees, supervisors who have authority to hire and discharge, and employees who have since quit or been discharged for cause, to deter- mine whether or not they desire to be represented by International Printing Pressmen & Assistants' Union of North America, affiliated with the American Federation of Labor, for the purposes of collec- tive bargaining. Pursuant'to the Direction, the election by secret ballot was, held on June 3, 1940, at Chicago, Illinois, under the direction and supervision of the Regional Director for the Thirteenth Region. On June 5. 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report containing a tally of the ballots. In his Report the Regional Director certified that the ballot was fairly and impartially con- 123 N. L. R. B. 731. 24 N. L. R. As to the balloting and its results, the Regional Director reported as follows : Total number of ballots cast---------------------------------- 89 Total number on eligible list---------------------------------- 98 Total number of ballots cast for the union-------------------- 14 Total number of ballots cast against the union---------------- 75 Total number of. challenged ballots-------------------------- 0 Total number of blank ballots --------------------------------- 0 Total number of void ballots---------------------------------- 0 No objections to the conduct of the ballot or to the Election -Report have been filed by any of the parties. .The results of the election show that no collective bargaining rep- resentativehas been selected by a majority of the employees in the appropriate unit. The petition of International Printing Pressmen & Assistants' Union of North America, affiliated with the American Federation of Labor, for investigation and certification of represen- tatives of employees of Century Engraving & Embossing Company, will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. "449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and cer- tification of representatives of employees of Century Engraving & Embossing Company, Chicago, Illinois, filed by International Print- ing Pressmen & Assistants' Union of North America, affiliated with the American Federation of Labor, be, and it hereby is, dismissed.
