Pursuant to and in accordance with the terms of the Direction, an election by secret ballot was con- ducted on January 21, 1938. Full opportunity was accorded to all parties to participate in the conduct of the secret ballot and to make challenges. The United Retail Employees of America, Local 108, herein called the U. R. E., did not avail itself of this opportunity to furnish tellers or otherwise participate. On January 24, 1938, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued her Intermediate Report on the election, copies of which were duly served on all the parties. No exceptions to the Intermediate Report were filed by any of the parties within the period of five days provided therefor by Article III, Section 9, of the Rules and Regulations, and the Intermediate Report was forwarded by the Regional Director to the Board in Washington, D. C., on February 4, 1938. By letter dated February 1, 1938, the U. R. E. charged that the employers involved in this proceeding had interfered with the conduct* of the election by coercing their employees in their choice of repre- sentatives. The Board has fully investigated this charge and finds it wholly without merit. 14 N. L. O_________________________________ 2 Total number of votes in favor of neither of the afore-mentioned labor organizations---------------------------------------- 2 Total number of blank votes_________________________________ 1 Total number of void ballots_________________________________ 0 Total number of challenged votes____________________________ 0 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act and pursuant to Article III, Sections 8 and 9, of National Labor Rela- tions Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED that Department & Variety Stores Employees' Union, Local 1115-A, Retail Clerks International Protective Associa- tion, has been designated and selected by a majority of all persons employed by Canadian Fur Trappers Corporation, Canadian Fur Trappers of New Jersey, Inc., Jordan's Inc., and Morris Dornfeld doing business as Werth's Wearing Apparel, in. their four stores located at Newark, New Jersey, and Paterson, New Jersey, excluding extra Saturday help, store managers, executives, and supervisors, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Department & Variety Stores Employees' Union, Local 1115-A, Retail Clerks International Protective Association, is the exclusive repre- sentative of such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other- conditions of employment. 80535-38--58 Copy with citationCopy as parenthetical citation
