F. OF L. Case No. R-1676 CERTIFICATION OF REPRESENTATIVES April 18, 1940 On March 8, 1940, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Election, an election by secret ballot was conducted on March 29, 1940, under the direction and supervision of the Regional Director for the Thirteenth Region (Chicago, Illinois). On April 3, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. The Regional Director reported the following results of the ballot- ing : Total on eligibility list-------------------------------------- 124 Total ballots cast------------------------------------------- 121 Votes cast for Mattress, Spring & Bedding Workers Local 185 of Upholsterers International Union of North America, affili- ated with the A. F. of L----------------------------------- 95 Votes cast against afore-mentioned union-------------------- 25 Total ballots challenged----------------------------------- 1 Total blank ballots----------------------------------------- 0 Total void ballots------------------------------------------- 0 Since the challenged ballot cannot affect the result of the election, we find it unnecessary to pass upon the challenge. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, 121 N. F. of L . has been designated and selected by a inajority of the metal -department employees of Burton -Dixie Corpo- ration , Chicago, Illinois , excluding office employees and foremen, as their representative for the purposes of collective bargaining and that, pursuant to Section 9 (a) of the Act, Mattress , Spring & Bedding Workers Local 185 of Upholsterers International Union of North America, affiliated with the A . F. of L ., is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment , and other con- ditions of employment.
