I. O. Cases Nos . C-1174 and R-1106 SUPPLEMENTAL DIRECTION OF ELECTIONS Marcia 19, 1940 On December 27, 1939, the National Labor Relations Board, herein called the Board, issued a Decision, Order, and Direction of Elec- tions 1 in the above-entitled proceeding ordering Max Bauman, Harry Bauman, Stanley Bauman, Morris Bauman, and Leo Bauman, doing business as Bauman Brothers Furniture Manufacturing Company, herein called the respondents,' to- cease and` desist from'`certain" unfair" labor practices and to take certain affirmative action found necessary to effectuate the policies of the National Labor Relations Act, 49 Stat. 449, and directing that elections by secret ballot be conducted ,at such a time as the Board should in the future direct under the direction and supervision of the Regional Director for the Twenty- first Region (Los Angeles, California). The Board has since been advised by the Regional Director that elections may be appropriately held at this time. In the absence of any showing that a current pay roll is inappropriate and in view of the time that has elapsed since the hearing, we shall adopt a current pay=roll date to determine eligibility to participate in the election. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act, and pursuant to Article III, Section 8, of National Labor Relations Board Rules and Regulations-Series 2, as amended, it is hereby DIRECTED that, as part of the investigation ordered by the Board to ascertain representatives for the purposes of collective bargaining with Max Bauma i Harry Bauman, Stanley Bauman, Morris Bau- man, and Leo Bauman,,doing business as Bauman Brothers Furni- ture Manufacturing Company, Los Angeles, California, elections by 118 N. B., No. 75. 772 MAX BAUMAN 773 secret ballot shall be conducted as early as possible but not later than thirty (30) days from the date of this Supplemental Direction of Elections , under the direction and supervision of the Regional Di- rector for the Twenty-first Region, acting in this matter as agent for the National Labor Relations Board and subject to Article III, Section 9 , of said Rules and Regulations , among : (a) All employees of the respondents who were employed during the pay -roll period next preceding the date of this Supplemental Direction of Elections , including employees who did not work dur- ing such pay -roll period because they were ill or on vacation and employees who were then or have since been temporarily laid off, but excluding office workers , teamsters , upholsterers , and supervisory employees , and those who have since quit or been discharged for cause, to determine whether they desire to be represented by United Furniture Workers of America, Local No. 576, affiliated with the Congress of Industrial Organizations , by Furniture Workers' Union Local No. 1561, affiliated with the United Brotherhood of Carpenters and Joiners of America , and also affiliated with the American Fed eration of Labor, or by neither, for the purpo ses of collective bargaining. (b) All upholsterers employed by the respondents during the pay- roll period next preceding the date-of this Supplemental Direction of Elections , including employees who did not work during such pay- roll period because they were ill or on vacation , and employees who were then or have since been temporarily laid off, but excluding those who have since quit or been discharged for cause , to determine whether they desire to be represented by United Furniture Workers of America , Local No. 576, affiliated with the Congress of Industrial Organizations, by Upholsterers ' International Union of North Amer- ica, Local No . 15, affiliated' with the American Federation of Labor, or by neither , for the purposes of collective bargaining.
