Case No. R-1688 SUPPLEMENTAL DECISION AND ORDER May 7, 1940 On February 23, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.1 The Direction of Election provided that an election by secret ballot be conducted as early as possible but not later than thirty (30) days from the date of the Direction, under the direction and supervision of the Regional Director for the Fourteenth Region, among all production and maintenance employees of the Com- pany who were employed during the pay-roll period next preceding the date of the Direction, including employees who did not work during such pay-roll period because they were ill or on vacation and employees who were then or had since been temporarily laid off, but excluding supervisory and office employees, chauffeurs, truck drivers, inside salesmen, and employees who had since quit or been discharged for cause, to determine whether they desired to be represented by Amalgamated Meat Cutters & Butcher Workmen of North America, Local 545, A. F. of L., by United Packinghouse Workers of America of Packinghouse Workers Organizing Committee, affiliated with the C. I. 0., or by neither, for the purposes of collective bargaining. Pursuant to the Direction, an election by secret ballot was con- ducted on March 21, 1940, under the direction and supervision of the Regional Director for the Fourteenth Region (St. Louis, Missouri). On March 22, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued and duly served upon the parties his Election Report. 120 N. F. of L_____________________ 30 Votes cast for neither_______________________________________ 53 Subsequent to the issuance of the Election Report, the Amalgam- ated Meat Cutters & Butcher Workmen of North America, Local 545, A. F. of L., herein called the Amalgamated, filed objections to the conduct of the ballot and the Election Report. On April 24, 1940, the Regional Director informed the Board that the Amalgamated had withdrawn the objections. The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees. The petition for investigation and certification of representatives of em- ployees of Armour and Company (St. Louis Branch House), St. Louis, Missouri, will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and certifi- cation of representatives of employees of Armour and Company (St. Louis Branch House), St. Louis, Missouri, filed by Amalgamated Meat Cutters & Butcher Workmen of North America, Local 545, A.
