Armco Finishing Corp., Inc.Download PDFNational Labor Relations Board - Board DecisionsJul 5, 19388 N.L.R.B. 67 (N.L.R.B. 1938) Copy Citation In the Matter of ARMCO FINISHING CORPORATION, INC . and TExTILE WORKERS ORGANIZING COMMITTEE Case No. R-696 CERTIFICATION OF REPRESENTATIVES July 5, 1938 On May 21 , 1938, the National Labor Relations Board , herein called the Board , issued a Decision and Direction of Election in the above- entitled case ., The Direction of Election directed that an election by secret ballot be conducted under the direction and supervision of the Regional Director for the Fifth Region ( Baltimore , Maryland) within twenty (20) days from the date of the Direction , among the piece-rate and hourly production employees of Armco Finishing Cor- poration , Inc., herein called the Company, at its Burlington, North Carolina , plant, who were employed by it during the pay-roll period immediately preceding December 15, 1937 , and in addition all such employees who were temporarily absent for illness or other cause during that pay-roll period; but excluding those who have since quit or been discharged for cause and also excluding supervisory and clerical employees, overseers , head dyers , head finishers , floor and shift bosses, and watchmen, to determine whether or not they desired to be represented by Textile Workers Organizing Committee, affil- iated with the Committee for Industrial Organization , for the pur- poses of collective bargaining. Pursuant to the Direction , an election by secret ballot was con- ducted on June 9, 1938, by the said Regional Director . On June 13, 1938, the said Regional Director , acting pursuant to Article III, Section 9 , of National Labor Relations Board Rules and Regula- tions-Series 1, as amended , issued , and on June 14 , 1938, served upon the parties an Intermediate Report on the election . I. 0------------------------------------ 54 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, herein called the Act, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED that Textile Workers Organizing Commit- tee, affiliated with the Committee for Industrial Organization, has been designated and selected by a majority of the piece-rate and hourly production employees of Armco Finishing Corporation, Inc., at its Burlington, North Carolina, plant, excluding supervisory and clerical employees, overseers, head dyers, 'head finishers, floor and shift bosses, and watchmen, as their representative for the purposes of collective bargaining, and that pursuant to Section 9 (a)' of the Act, Textile Workers Organizing Committee, affiliated with the Com- mittee for Industrial Organization, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
