Case No. R-834 CERTIFICATION OF REPRESENTATIVES August 4, 1938 On June 28, 1938, the National Labor Relations Board issued a Decision and Direction of Election in the above-entitled proceeding.' The Direction of Election provided that an election by secret ballot be conducted within fifteen (15) days from the date of the Direction among the samplers, checkers, watchmen, sugar warehouse and shipping employees, porters, elevator operators, boilerhouse employees, assist- ant foremen, and production and maintenance employees of Margaret A. Jamison and Martha Jamison, partners doing business as Arbuckle Bros., New York City, herein called the Company, who were employed by the Company during the pay-roll period ending March 19, 1938, excluding foremen, clerical and supervisory employees, and technical, laboratory and hospital employees, and those who have since quit or been discharged for cause, to determine whether they desired to be represented by the Committee for Industrial Organization or by Local 1476, Sugar Refinery Workers, of the International Longshoremen's Association for the purposes of collective bargaining, or by neither. Pursuant to the Direction of Election, an election by secret ballot was conducted on July 12, 1938, at Brooklyn, New York, under the direction and supervision of the Regional Director for the Second Region (New York City). Full opportunity was accorded to all parties to this investigation to participate in the conduct of the ballot and to make challenges. On July 16, 1938, the Regional Director, act- ing pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, duly served upon the parties her Intermediate Report dated July 15, 1938, on the secret ballot. A--------- 486 Neither Organization ------------------------------------ 13 Total Number of Blank Votes________________________________ 3 Total Number of Void Ballots --------------------------------- 6 Total Number of Challenged Votes___________________________ 15 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED, that Local 1476, Sugar Refinery Workers, of the International Longshoremen's Association, has been selected by a majority of the samplers, checkers, watchmen, sugar warehouse and shipping employees, porters, elevator operators, boilerhouse employees, assistant foremen, and production and maintenance employees of Margaret A. Jamison and Martha Jamison, partners doing business as Arbuckle Bros., New York City, excluding foremen, clerical and supervisory employees, and technical, laboratory and hospital em- ployees, as their representative for the purposes of collective bargain- ing, and that, pursuant to Section 9 (a) of the Act, Local 1476, Sugar Refinery Workers, of the International Longshoremen's Association, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
