Pursuant to the Direction of Election, an elec- tion by secret ballot was conducted on May 20, 1940, under the direction and supervision of the Regional Director for the Third Region (Buf- falo, New York). On May 21, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report on the ballot. No objections to the conduct of the ballot or the Election Report had been filed by any of the parties. B., No. 33. 283035-42-vol. 24-27 405 406 DECISIONS OF NATIONAL LABOR RELATIONS BOARD IT IS HEREBY CERTIFIED that International Typographical Union has been designated and selected by a majority of the composing-room employees of American Sales Book Company, Inc., Niagara Falls, New York, excluding supervisors, clerks, proofreaders, mat readers, electroplater apprentices, and all other apprentices having less than one year's experience in composing-room work, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, International Typographical Union is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
