R-870 to R-899, inclusive, XV-R-198, R-900, R-901, R-901, XV-R-SOP,, R-903 to R-925, inclusive AMENDMENT TO DECISION AND DIRECTION OF ELECTIONS October 7, 1938 On September 29, 1938, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election 1 in the above-entitled proceeding. In paragraph numbered 3 of the Direction, the Board directed separate elections among the banana handlers employed at the Port of New Orleans by United Fruit Company and Standard Fruit R Steamship Company, respectively, to determine whether they desire to be represented by International Longshoremen and Warehousemen's Union, affiliated with the Com- mittee for Industrial Org:ulization, or by International Longshore- mmen's.-Association, for the purpose of collective bargaining, or by neither. The International Longshoremen's Association has advised the Regional Director for the Fifteenth Region that it wishes to be designated on the ballot as "Banana Handlers, International Long- shoremen's Association, Local No. 1515" and we shall so direct. The Board hereby amends the Direction of Elections by striking from paragraph numbered 3 of the Direction the words, "Interna- tional Longshoremen's Association," and by substituting therefor the words, "Banana Handlers, International Longshoremen's Association, Local No. 1515." The Board hereby farther amends the Decision and Direction of Elections by striking "Agwilines, Inc." from the first paragraph of footnote 27 and from appendix B and by adding the words "Ag- :wilines, Inc," to the second paragraph of footnote 27 and to appen- dix E. MR. DONALD WAKEFIELD SMITH took no part in the consideration of the above Amendment to Decision and Direction of Elections. 18 N L R. B 1325 74 {SAME TITLE NATIONAL LABOI; HI':L A'I IONS BO A-111) SUPPLEMENTAL DECISION CERTIFICATION OF REPRESENTATIVES DIRECTION OF ELECTION AND ORDER November 9, 19-38 On September 29, 1938, the Board issued a Decision, Direction of Elections and Order in the above-entitled case. On October 7, 1938, the Board issued an amendment to its Decision and Direction of Elections. Pursuant to the Direction of Elections, elections by secret ballot were conducted on October 14, 1938, by the Regional Director for the Fifteenth Region. Full opportunity was afforded all the parties to the investigation to participate in the conduct of the secret ballots and make challenges. On October 19, 1938, the Regional Director for the Fifteenth Region issued and, on October 20, 21, and 22, 1938, duly served upon the parties to the proceeding his Intermediate Re- port on the ballot. The Regional Director reported that no elections were con- ducted among these groups because the companies involved did not employ any persons eligible to participate in such elections within the provisions of the Direction of Elections, as amended. Upon the entire record in the case the Board makes the following : SUPPLEMENTAL FINDINGS OF FACT In its Decision the Board made no final determination as to the appropriate units for the purposes of collective bargaining with those companies which employed both longshoremen and checkers 4 The Board decided that the final determination of the units at such companies should depend upon the , results of elections which the Board directed at these companies. If, at a given company, both groups of employees chose the I. L. W. U. they were together to constitute a single bargaining unit; if they did not, each group choos- ing to be represented by a union was to constitute a separate bar- gaining unit. In accordance with this principle and in view of the results of the elections which have been noted previously we find that the persons 4 These are the companies listed in appendix "E" of the original Decision. 88 NATIONAL LABOR RELATIONS BOARD employed to do longshore work by each of the companies listed in appendix "H," respectively, including longshoremen, sack sewers and water boys and excluding car loaders and warehousemen who are not also employed as longshoremen, foremen paid on a monthly or weekly basis, banana handlers, superintendents, assistant super- intendents, watchmen, timekeepers, paymasters, and clerks and checkers constitute units appropriate for the purposes of collective bargaining, and that said units will insure to the afore-mentioned employees the full benefit of their right to self-organization and collective bargaining and otherwise effectuate the policies of the Act. We further find that the persons employed as clerks and checkers by Agwilines, Inc., Coastal Freight Handlers, Inc., Mississippi Ship- ping Co., Inc., The New York and Porto Rico Steamship Company, and T. Smith & Son,-Inc.; respectively, excluding chief clerks and those who are not -employed to check cargo to and from ships con- stitute units appropriate for the purposes of collective bargaining and that said units will insure to the afore-mentioned employees the full benefit of their right to self-organization for collective bargain- ing and otherwise effectuate the policies of the Act. Since a majority of the clerks and checkers employed by each of the companies listed below b did not choose to be represented by a union, they do not, pursuant to our Decision, constitute appropriate bargaining units. We shall therefore, dismiss the petitions for in- -vestigation and certification of representatives of employees of these companies in so far as the petition relates to those employed as clerks and checkers. We shall also dismiss the petitions for investigation and certifica- tion of representatives of employees of the following companies since no persons were eligible to vote at the elections directed among them : Tampa Interocean Steamship Company, J. L. Stulb, doing business under the trade name of Texla Stevedoring Company, J. L. Stulb, doing business under the trade name of Gulf Shipping Company, Page L'Hote Company, Ltd., Vogemann-Goudriaan Co., Inc. We shall also dismiss the petitions for investigation and certifica- tion of employees of the following companies since a majority of those voting at the elections conducted among the respective em- ployees of these companies have not signified that they desire to be 'represented by a labor organization : American Baltic Chartering & Shipping Co., Inc., E. S. Binnings, Richard Meyer Company, Ocean Dominion Steamship Corporation, Plant Shipping Company, Inc., 'Swayne & Hoyt, Ltd. 5 Alfred LeBlanc , Inc., Luckenbach Gulf Steamship Company Inc., Lykes Bros.-Ripley Steamship Co, Inc., Ryan Stevedoring . DECISIONS AND ORDERS' Oceanic Stevedoring Company (of Louisiana), Inc. 89 The results of the election at Oceanic Stevedoring Company (of Louisiana) Inc. show that all those voting at the election have indi- cated a desire to bargain collectively with the company, but that none of the three competing labor organizations has been given a majority of the ballots cast. The Regional Director reported in his supplemental Intermediate Report that the I. L. W. U. had notified him that it desired a run-off election to determine whether or not the employees of this company desire to be represented by the I. L. W. U., the union receiving the greatest number of votes, for the purposes of collective bargaining. It has been the practice of the Board to grant such a request in similar circumstances.s The Board finds that in order fully to resolve the question concerning representation, a run-off election should be held and will so direct. Strachan Shipping Company As we have previously noted, only one of the two persons eligible to vote at the election conducted, among the employees of Strachan Shipping Company voted. Nevertheless, we shall in accordance with our past decisions certify the Clerks and Checkers Local; for whom the vote was cast, as the exclusive bargaining representative of the employees of Strachan Shipping Company.7 Upon the basis of the above findings of fact and upon the entire record in the case, the Board makes the following : SUPPLEMENTAL CONCLusIONs OF LAW 1. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED that General Longshore Workers, Inter- national Longshoremen's Association, Nos. 1418 and 1419, has been designated and selected by a majority of the persons employed to do longshore work at the Port of New Orelans by each of the com- panies listed in appendix "F," respectively, including longshoremen, sack sewers, and water boys and excluding car loaders and ware- housemen who are not also employed as longshoremen, foremen paid on a monthly or weekly basis, superintendents, assistant superintend- ents,-watchmen; timekeepers, paymasters, and clerks and checkers as their representative for the purposes of collective bargaining and that pursuant to Section 9 (a) of the Act, General Longshore Work- ers, International Longshoremen's Association Nos. 1418 and 1419 is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment; IT IS HEREBY CERTIFIED that International Longshoremen and Warehousemen's Union has been. designated and selected by a major- ity of the persons employed to do longshore work at the Port of New Orleans by New Orleans Stevedoring Company, Inc., including longshoremen, sack sewers and water boys and excluding car load- ers and warehousemen who are not also employed as longshoremen, foremen paid on a monthly or weekly basis, superintendents, assist- ant superintendents, watchmen, timekeepers, paymasters and clerks and checkers as their representative for the purposes of collective bargaining and that pursuant to Section 9 (a) of the Act, Interna- tional Longshoremen and Warehousemen's Union is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment; IT IS HEREBY CERTIFIED that International Longshoremen's Associa- tion Local No. 1497 has been designated and selected by a majority of the persons employed as clerks and checkers at the Port of New DECISIONS AND ORDERS 91 Orleans by each of the companies listed in appendix "G," respec- tively, excluding chief clerks and clerks who are not engaged in the checking of cargo to and from ships, as their representative for the purposes of collective bargaining and that pursuant to Section 9 (a) of the Act, International Longshoremen's Association Local No. 1497 is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment; IT IS HEREBY CERTIFIED that Banana Handlers International Long- shoremen's Association, Local No. 1515, has been designated and selected by a_ majority of the persons employed as banana handlers at the Port of New Orleans by United Fruit Company and Standard Fruit & Steamship Company, respectively, as their representative for the purposes of collective bargaining and that pursuant to the provisions of Section 9 (a) of the Act, Banana Handlers Interna- tional Longshoremen's Association, Local No. 1515, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment. DIRECTION OF ELECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Section 8, of National Labor Relations Board Rules and Regulations-Series 1, as amended, it is hereby DIRECTED that, as part of the investigation authorized. by the Board to ascertain representatives for the purposes of collective bargaining with Oceanic Stevedoring Company (of Louisiana), Inc., an election by secret ballot shall be conducted within fifteen (15) days from the date" of this Direction under the direction and supervision of the Regional Director for the Fifteenth Region, acting in this matter as agent for the National Labor Relations Board, and subject to Article III, Section, 9, of said Rules and Regulations, among the persons employed to do longshore work at the Port of New Orleans by Oceanic Stevedoring Company (of Louisiana), Inc., including longshoremen, sack sewers, and water boys, and excluding car loaders and warehousemen who are not also employed as longshoremen, foremen paid .on a monthly or weekly basis, superintendents, assistant superintendents, watchmen, time- keepers, paymasters, and clerks and checkers, to determine whether or not they desire to be represented by International Longshoremen and Warehousemen's Union, affiliated with the Committee for In- dustrial Organization, for the purposes of collective bargaining. 92 NATIONAL LABOR RELATIONS BOARD Eligibility to vote in the election will be determined by the stand- ards set, forth in the Direction of Elections which originally directed an election to be held among the persons employed to do longshore work by Oceanic Stevedoring Company (of Louisiana), Inc.
